The 2024 summer season has entered a new era with the change in housing rental rules.
The amendment made to the “Regulation Aiming to Regulate the Rental of Housing Activities for Tourism Purposes”, known as the “Airbnb” regulation , marks a new era in the housing rental sector. According to this regulation, in order to rent a house as a summer house, the approval of the residents of the apartment or site is required. This situation causes detached houses to be preferred instead of areas with many houses.
As the summer season approaches, housing rental advertisements began to intensify. A striking point in these advertisements is the prominence of detached houses. The new “Airbnb” regulation complicates the rental procedures in apartments and sites, directing holidaymakers to detached houses.
Residential rentals exceeding 100 days are not considered within the scope of the “Regulation Aiming to Regulate the Activities of Renting Housing for Tourism Purposes” . Minister of Culture and Tourism, Mehmet Ersoy, announced that this process would have a legal basis, as it does all over the world, to access accurate information about tourist data and accommodation, and the regulation was implemented at the end of December.
APPROVAL OF FLAT OWNERS IS REQUIRED
According to the “Regulation Aiming to Regulate the Activities of Renting Residences for Tourism Purposes “, certain conditions must be met in order to carry out rental activities in a residence for tourism purposes. One of these conditions is that a notarized copy of the decision taken unanimously by the flat owners of all independent residential units in the building is required. If the permit application is made by a housing business or travel agency, a document showing the approval of the lessor and the approval of the management company is requested.
If the number of residences for which a permit is requested from the same lessor in the same building exceeds 5, a business and working license is required.
